Terms of Service

1. Acceptance of Terms

By accessing or using BookWell.host ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

BookWell.host provides an embeddable booking widget platform that allows property owners to accept direct bookings through their websites. The Service includes a booking widget, management dashboard, and payment processing integration via Stripe.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Misrepresent your property, availability, or pricing to guests
  • Attempt to reverse engineer, decompile, or disassemble the Service
  • Interfere with or disrupt the Service or servers connected to it
  • Use the Service to send spam or unsolicited communications
  • Upload or transmit viruses, malware, or other malicious code

5. Payments and Fees

  • Free Plan: Available at no monthly cost with a 5% platform fee per booking.
  • Paid Plans: Subject to the pricing displayed at the time of subscription. Prices may change with 30 days' notice.
  • Payment Processing: Stripe processes all guest payments. Stripe's fees apply in addition to BookWell platform fees.
  • Refunds: Property owners are responsible for their own refund policies with guests. BookWell platform fees on refunded bookings are non-refundable.

6. Property Owner Responsibilities

As a property owner using BookWell.host, you are responsible for:

  • Maintaining accurate property information, room details, and pricing
  • Honoring confirmed bookings made through your widget
  • Complying with all applicable hospitality laws and regulations in your jurisdiction
  • Handling guest communications, check-ins, and any disputes
  • Collecting and remitting applicable taxes

7. Intellectual Property

The Service, including its design, code, features, and documentation, is owned by BookWell.host and protected by intellectual property laws. You retain ownership of all content you upload to the Service (property descriptions, images, etc.).

8. Data and Privacy

Our collection and use of personal information is governed by our Privacy Policy. By using the Service, you consent to our data practices as described therein.

9. Limitation of Liability

To the maximum extent permitted by law, BookWell.host shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claims arising from the Service shall not exceed the amount you paid to BookWell.host in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

11. Termination

You may terminate your account at any time from your dashboard settings. We may suspend or terminate your account if you violate these Terms. Upon termination:

  • Your access to the Service will be revoked
  • Existing bookings will still be honored
  • You may request export of your data within 30 days

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website. Continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BookWell.host operates, without regard to conflict of law principles.
